1   GENERAL & DISCLAIMER

1.1    In these Terms & Conditions (“T&Cs”), “we”, “us”, “our”, and “Classic” refer to >Classic Sports Industries NZ Limited, the operator of the NZ Super Rugby Clubs Online Store on behalf of the New Zealand Super Rugby Clubs.

1.2    This website and online store (the “Website”) provides a retail channel for customers to purchase official New Zealand Super Rugby Clubs merchandise.

1.3    Your rights under the New Zealand Consumer Guarantees Act 1993 (CGA) apply and are not excluded by these T&Cs.

1.4    We endeavour to ensure the Website is functional and up to date. However, to the maximum extent permitted by law: • we do not guarantee uninterrupted access to the Website • we are not liable for indirect, incidental, or consequential loss except where required by law, including: o death or personal injury caused by negligence o fraud or fraudulent misrepresentation o any mandatory product liability obligations

1.5    Images and illustrations on the Website are sample representations only and actual products may vary slightly.

1.6    Information on the Website is provided in good faith. We do not warrant the accuracy or completeness of information provided by suppliers or partners.

2   ACCEPTANCE

2.1    Your access and use of the Website constitutes your agreement to these T&Cs.

2.2    We may amend these T&Cs with reasonable notice. Continued use of the Website after updates constitutes acceptance.

2.3    These T&Cs are governed by New Zealand law, and you submit to the non-exclusive jurisdiction of New Zealand courts.

3   ORDERS, PRICING & AVAILABILITY

3.1    Prices are in NZD and include GST where applicable. Delivery charges are additional as displayed.

3.2    Your order is an offer to purchase products. A contract is formed only when we issue an order confirmation email.

3.3    We may reject any order due to unavailability, errors in product information or pricing, or incomplete/incorrect order details.

3.4    Online pricing may differ from in-store or event pricing.

3.5    You are responsible for any applicable duties or customs charges on international deliveries.

4   DELIVERY & TRACKING

4.1    Orders dispatch from New Zealand. We ship locally and internationally.

4.2    Dispatch is generally within 1–5 business days.

4.4    Deliveries may require signature. Missed deliveries may be redirected for collection. A street address is preferred.

4.5    If parcels are returned due to non-delivery, additional freight charges may apply.

4.6    Delivery times are estimates and may vary due to carrier delays, weather, peak periods or customs processing.

4.7    Tracking information will be provided where available.

5   DELIVERY & TRACKING

5.1    Freight is charged as per the cost provided at checkout.

5.2    Free freight promotions (if any) exclude express and international shipments.

5.3    Large or bulky orders may incur additional charges.

5.4    International customers are responsible for taxes, duties, and clearance charges.

6   PAYMENT

6.1    Payment is required at checkout. You may cancel an order before payment is submitted.

6.2    We accept Visa, Mastercard, and other methods offered on the Website.

6.3    All international orders are billed in NZD, unless stated otherwise or unless the payment provider permits payment in another supported currency.

6.4    Gift Vouchers (if offered) are valid for 36 months, cannot be redeemed for cash, and must be treated like cash.

6.5    Only one Gift Voucher may be used per transaction.

6.6    Discount Codes
Only one discount code or promotional offer may be applied per transaction. Some discounts may not be used in conjunction with Gift Vouchers unless expressly stated.

7   RISK AND TITLE

7.1    Ownership passes once full payment is received. Risk transfers upon delivery to the courier.

7.2    Consider transit insurance if required.

8   RETURNS AND REFUNDS

8.1    Subject to clauses 8.4 and 8.5 and your statutory rights, if you are not satisfied for any reason we may issue a credit note for the returned items; you must contact us within 14 days of receipt (or 30 days in the case of faults).

8.2    Returns must be unused, in original packaging, and with tags intact. We may refuse returns that do not meet these conditions.

8.3    Refunds are issued to the original payment method within 7 business days once inspected.

8.4    Please choose your apparel and personalisation carefully as no refund or exchange on personalised items unless faulty.

8.5    Sale or promotion items cannot be returned unless faulty.

8.6    Your rights under the CGA always apply.

9   CANCELLATIONS AND LOSS OR DAMAGE IN TRANSIT

9.1    To cancel, contact Online@shop.nzsuperrugbyclubs.co.nz immediately. If not yet dispatched, we will cancel and refund. If dispatched, normal returns policy applies.

9.2    Although we use reliable carriers, mishaps can occur. If delayed, damaged, or missing, contact us promptly so we can assist.

9.3    We are not liable for losses in transit; tracking is used for this reason.

10   INTELLECTUAL PROPERTY

10.1    Copyright in the Website (software, design, text, graphics, selection/layout, content/materials) is owned by or licensed to us.

10.2    You must not modify/copy/reproduce/upload/transmit/sell/distribute or publicly communicate any material without our prior written consent; do not frame/embed Website material without consent.

10.3    You may store/print copies solely for viewing and purchasing products.

10.4    Trademarks on the Website are protected by law. Do not use our marks/names or third-party marks without prior written consent from the relevant owner.

11   PRIVACY

11.1    Your personal information is handled in accordance with our NZ Super Rugby Clubs Online Store Privacy Policy.

11.2    By using this Website, you agree to the handling of your data as outlined.

12   REGISTRATION

12.1    You may register before placing an order. Any personal information you provide will be used per the Privacy Policy.

12.2    One active account per person; accounts are non-transferable. You may update/edit/terminate your account via the Website.

12.3    If you use a workplace email, you are responsible for complying with your workplace rules/policies.

13   SALE AND PROMOTION TERMS & CONDITIONS

Notwithstanding anything in these Terms & Conditions, if you purchase a product that is subject to a sale or promotion, sale and promotion terms and conditions will apply to your purchase of that product. The applicable sale and promotion terms and conditions will take precedence in the case of any inconsistency with these Terms & Conditions.
